Terms of Service

These Terms of Service govern your use of ovrsaid.com and purchases made from OVRSAID.

By using this website or placing an order, you agree to these Terms, subject always to any mandatory rights that cannot legally be excluded.

2. Our products

We sell apparel and related merchandise, including standard products and personalized products.

We make reasonable efforts to display product photographs, colors, dimensions, descriptions and pricing accurately. However, screen settings, manufacturing tolerances and photographic conditions can result in minor visual differences.

3. Personalized products

Our MAKE YOUR OWN STATEMENT product allows you to submit wording for printing on a garment.

Custom statements are converted to capital letters for production.

You are responsible for reviewing:

the wording;
spelling;
punctuation;
size selection;
other customer-selected information

before placing the order.

The statement stored on your completed Shopify order is the production instruction for that item.

A visual preview is intended to show the approximate layout and appearance of the statement. Minor differences in line placement, sizing or print positioning may occur during physical production.

Personalized goods are excluded from the ordinary statutory withdrawal right where the applicable legal requirements are met. This does not remove your rights if the goods are defective or not produced in conformity with the order.

4. Custom statement restrictions

You must not knowingly submit content that:

is unlawful;
infringes another person’s intellectual-property rights;
constitutes an unlawful threat or targeted unlawful harassment;
requires us to reproduce material that we reasonably believe we are not legally permitted to reproduce.

We may refuse or cancel a custom order where we reasonably believe production would violate applicable law or third-party rights.

If we cancel an order for this reason before production, we will refund the amount paid for the cancelled item.

5. Orders

Submitting an order constitutes an offer to purchase the selected products.

An order is accepted when we confirm acceptance or begin fulfilling it, subject to applicable consumer law.

We may cancel an order before fulfillment where reasonably necessary, including in cases of:

obvious pricing or technical errors;
payment failure;
suspected fraud;
inability to supply the product;
unlawful custom content.

Where we cancel a paid order, the relevant amount will be refunded.

6. Prices and payment

Prices displayed on the website are shown in the currency selected for your market.

Applicable taxes are handled according to the destination and checkout configuration.

Shipping costs, if any, are shown before you complete payment.

Payment must be successfully authorized through one of the payment methods available at checkout.

7. Promotions and discounts

Promotional offers may be subject to:

expiration dates;
product exclusions;
minimum-order values;
geographical restrictions;
non-combination rules.

We may modify or end a promotion prospectively, but this does not affect orders already validly completed under that promotion.

8. Shipping and delivery

Shipping is governed by our Shipping Policy, which forms part of these Terms.

Delivery estimates are not guaranteed delivery dates unless explicitly stated otherwise.

9. Returns and refunds

Returns, withdrawals, refunds and custom-product exclusions are governed by our Refund & Returns Policy.

Nothing in these Terms restricts rights granted to consumers by mandatory applicable law.

10. Faulty or non-conforming goods

If a product is defective or does not conform to the contract, you are entitled to the remedies provided by applicable consumer law.

For new goods sold to consumers in Spain, the statutory conformity responsibility period is three years from delivery.

11. Intellectual property

The OVRSAID name, branding, logos, website design, original graphics, product artwork, photographs and other proprietary materials are owned by or licensed to us and are protected by applicable intellectual-property law.

You may not reproduce, distribute, commercially exploit or create unauthorized derivative commercial materials from our protected content without permission.

12. Website use

You must not use the website to:

interfere with its operation or security;
introduce malicious code;
attempt unauthorized access;
scrape or exploit the website in a way that materially disrupts its operation;
use the service for unlawful purposes.

13. Third-party services

Our store may use third-party services such as Shopify, payment providers, shipping carriers and social platforms.

Their services may be governed by separate terms and privacy practices.

14. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including mandatory consumer rights.

To the maximum extent permitted by applicable law, we are not responsible for losses caused solely by circumstances outside our reasonable control where no applicable legal rule makes us responsible.

15. Changes to these Terms

We may update these Terms from time to time.

Changes apply prospectively from the date the revised Terms are posted and do not retroactively alter rights attached to orders already concluded, except where required by law.

16. Governing law

These Terms are governed by Spanish law.

If you are a consumer residing elsewhere, this choice of law does not deprive you of mandatory consumer protections that apply to you under the law of your habitual residence where applicable.
